1. Acceptance of Terms

By accessing or using Brewey ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Brewey is an AI-powered beer recipe creation and management application designed for homebrewers. The Service provides tools for:

  • Creating and storing beer recipes
  • Accessing brewing calculations and conversions
  • Utilizing AI assistance for recipe development
  • Managing brewing ingredients and processes
  • Exporting and sharing recipes

3. Acceptable Use

The Service is intended for:

  • Personal homebrewing use by individual hobbyists
  • Educational purposes related to brewing
  • Non-commercial recipe development and storage

You agree to use the Service in compliance with all applicable laws and regulations, including those related to alcohol production in your jurisdiction.

4. Prohibited Uses

You agree NOT to:

  • Use automated systems, bots, or scrapers to access the Service
  • Create multiple accounts for the purpose of circumventing fair use limits or welcome credits
  • Use the Service for commercial recipe database operations
  • Resell, redistribute, or sublicense access to the Service
  • Attempt to reverse engineer or extract source code from the Service
  • Store or transmit malicious code or content
  • Impersonate others or provide false information
  • Use the Service to violate any laws or regulations
  • Overwhelm the Service with excessive requests or usage

5. User Accounts

Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to create an account (or the legal age for alcohol-related content in your jurisdiction)
  • You must maintain a valid, current email address as this is our only method of contacting you for important service notices

Account Termination

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms of Use
  • Engage in abusive or excessive usage
  • Remain inactive for extended periods
  • Are associated with fraudulent activity

6. Content Ownership and Rights

Your Content

  • You retain all rights to recipes and content you create using the Service
  • By using the Service, you grant us a limited license to store and process your content solely for the purpose of providing the Service
  • You are responsible for ensuring you have the right to use any content you upload

Our Content

  • The Service, including its design, features, and documentation, is owned by Brewey
  • BJCP style guidelines and ingredient databases are used under fair use for educational purposes

7. AI Usage and Credits

  • AI features consume credits based on usage
  • Credit costs and consumption rates are subject to change without notice
  • All credits are non-refundable and non-transferable
  • Credits have no cash value and cannot be exchanged
  • We reserve the right to implement usage limits to ensure fair access for all users
  • In the event of service termination, we will provide at least 30 days notice via email to your registered email address, after which all unused credits expire without refund
  • By using AI features, you agree that your conversations and profile data will be processed by third-party AI providers (OpenAI, Anthropic, OpenRouter) subject to their respective Terms of Service and Privacy Policies

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Service Availability and Modifications

  • The Service is provided "as is" without guarantees of uptime or availability
  • We reserve the right to modify, suspend, or discontinue features with or without notice
  • We may implement fair use limits or usage restrictions as necessary
  • Scheduled maintenance will be communicated when possible
  • In the event of complete service termination, we will provide at least 30 days advance notice via email to your registered email address
  • Upon service termination, you will have 30 days from the termination date to export your data before permanent deletion
  • It is your responsibility to maintain a current email address in your account settings

10. Disclaimers

Data Deletion is Permanent

IMPORTANT: ALL DELETIONS ARE PERMANENT AND IRREVERSIBLE. We do not maintain a "trash" or "recycle bin" feature. When you delete a recipe or your account, the data is immediately and permanently removed. We cannot and will not restore deleted data, even if deleted by accident or by the AI assistant in error. You are responsible for maintaining your own backups using the /export feature.

No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

Brewing Disclaimer

  • Recipes and calculations are provided for informational purposes only
  • Users are responsible for verifying calculations and following safe brewing practices
  • We are not responsible for failed batches, injuries, or damages resulting from use of the Service
  • Always follow local laws regarding alcohol production

Limitation of Liability

IN NO EVENT SHALL BREWEY OR ITS CREATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Brewey and its creator from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your brewing activities

12. Fair Use Policy

To ensure quality service for all users:

  • Reasonable personal use is expected (typically < 1000 recipes per account)
  • API usage should not exceed reasonable hobbyist levels
  • Bulk operations should be performed during off-peak hours when possible
  • We may contact users with unusually high usage to discuss their needs

13. Third-Party Services

The Service integrates with third-party services, including but not limited to:

  • AI Providers (OpenAI, Anthropic, OpenRouter): Process your conversations and profile data
  • Authentication (Google OAuth, Supabase Auth): Handle secure login
  • Database/Hosting (Supabase): Store and manage your data

Your use of these integrations is subject to their respective Terms of Service and Privacy Policies. We are not responsible for the data practices of these third parties once your data is transmitted to them.

14. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good faith negotiation or, if necessary, through appropriate legal channels.

Important: We communicate service notices only via the email address registered to your account. It is your responsibility to ensure this email address remains current and accessible.

17. Severability

By using Brewey, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
